This is one of the most common bamboo-removal calls we get, and the most frustrating for the homeowner. Bamboo doesn’t respect fence lines — running bamboo rhizomes travel several metres horizontally underground and pop up shoots wherever the soil gives them an opening. If the source is your neighbour’s property, treating only your side is like mopping the floor while the tap is still running. There are three paths forward, in order of effectiveness.

Joint treatment is the only path to permanent eradication when the bamboo source is the neighbour’s plant. When the neighbour won’t cooperate, a properly installed HDPE root barrier 60-90cm deep blocks about 80% of cross-property rhizome travel. Not perfect, but a strong defence. Cost is a one-off install rather than a multi-year programme. It doesn’t kill the existing bamboo on your side — it just stops new rhizomes coming through. Acceptable when: a small incursion, slow-spreading clumping bamboo, or the neighbour is planning to remove eventually. It’s a holding action, not a fix. There’s an ongoing cost of re-treating every season as new rhizomes push through from the neighbour’s side. When you’ve had enough of this, escalate back to Path 1 or 2.

Bamboo isn’t a protected species under NSW vegetation rules — homeowners can remove their own bamboo without a council permit (see our council approval guide). Bamboo also isn’t classified as a noxious weed in most NSW councils. There’s no automatic right to treat bamboo on your neighbour’s property without their permission. Branches/rhizomes that cross onto your property: you can remove what’s on your side, but trespassing onto their side requires consent. For disputes: NSW Department of Communities and Justice (incl. Community Justice Centres) provide free mediation before any legal route via NCAT.

Who’s legally responsible for bamboo that crosses the boundary?
Under the NSW Dividing Fences Act 1991, the landowner of the property the bamboo originates from is the primary responsible party. If the bamboo is causing damage to your property, you can request they control it. If they refuse, you can apply to NCAT for an order requiring them to act.
Can I just cut the rhizomes that have crossed onto my side?
Yes — you’re entitled to remove any roots or rhizomes that have crossed onto your land. You don’t need your neighbour’s permission for that. But it’s a temporary fix — the bamboo is still on their side and will keep sending rhizomes back.
What should I say to my neighbour first?
Keep it factual. Show them photos of where the bamboo has crossed. Get a quote from us for joint removal (their side + your side + shared barrier) and present the 50/50 cost. Most neighbours, when shown the alternative is NCAT, agree to split the cost.
My neighbour says it’s my problem because it’s on my side now.
That’s incorrect under NSW law. The source of the bamboo is the responsible party. Cite the Dividing Fences Act 1991 in a written letter and request action within 30 days. Keep copies — you’ll need them if you escalate to NCAT.
How does NCAT mediation work?
NCAT is the NSW Civil and Administrative Tribunal. You lodge a Tree Disputes application (covers bamboo) for $0-$54. NCAT arranges mediation; if that fails, a tribunal member makes a binding decision. Average resolution time is 8-12 weeks.
What if my neighbour’s bamboo is damaging my pool or fence?
Document everything. Get repair quotes. NCAT can order the neighbour to pay for damage caused by their bamboo, plus the cost of removal and barrier installation. Photos with dates are essential evidence.
